Medical experts are warning of another deadly pandemic winter as Covid-19 numbers tick up and flu season threatens. The US is back at a point where more than 2,000 people are dying of Covid-19 every day on average, according to data from Johns Hopkins University. Additionally, about 12,000 to 50,000 Americans lose their lives to flu every year. The best way to avoid another devastating season, doctors say, is to get vaccinated for both. Meanwhile, parts of Southeast Asia, including Indonesia, Malaysia, Thailand and Vietnam, are coming out of long lockdowns and abandoning their \xe2\x80\x9czero Covid\xe2\x80\x9d strategies. Leaders want to revive their countries\xe2\x80\x99 economies, especially their tourism sectors, but experts are worried that low vaccination rates in the region could spell disaster.

The climate crisis was front and center at the UN General Assembly yesterday. Chinese President Xi Jinping recorded a rare address to the UN body promising to halt coal projects, Turkish President Recep Tayyip Erdogan said his country will present the Paris climate agreement to its parliament next month, and US President Joe Biden and UK Prime Minister Boris Johnson stressed further climate action during an Oval Office meeting. An array of international points of conflict were also addressed by the dozens of world leaders present, including nuclear arms in Iran, free and fair elections in Venezuela, and competition between the US and China. The Taliban have also requested representation at this week\xe2\x80\x99s meeting, a move that is expected to kick off a diplomatic battle with the preexisting Afghan envoy.

3. Congress

Progressive Democrats have announced they will not vote for the $1 trillion bipartisan infrastructure bill without passing the $3.5 trillion package that is aimed at enacting President Joe Biden\xe2\x80\x99s economic agenda. That vote is scheduled for next week, and as it stands, House Speaker Nancy Pelosi can afford to lose only a handful of votes to get anything passed. President Biden will increase his engagement with Congressional Democrats today, including a meeting with Pelosi and Senate Majority Leader Chuck Schumer, to try and get all the Democratic factions in line. Yesterday, the House also passed a bill to avoid a government shutdown and suspend the US debt limit. The bill is unlikely to pass the Senate, so the country is still approaching a possible shutdown and financial precipice in the coming weeks.

4. Trump revelations

Several recent revelations have shed light on then-President Trump and his supporters\xe2\x80\x99 plans to subvert the Constitution and keep him in power after the 2020 election. These revelations are likely to be of high interest to the House select committee investigating the January 6 insurrection. For instance, a newly revealed memo shows a conservative lawyer working with Trump\xe2\x80\x99s legal team tried to convince then-Vice President Mike Pence that he could overturn the election results on January 6 when Congress counted the Electoral College votes. The six-step scheme, which included throwing out electors from seven states, was outlined in a two-page memo obtained by Washington Post journalists Bob Woodward and Robert Costa for their book, \xe2\x80\x9cPeril.\xe2\x80\x9d The memo was then obtained by CNN.

5. Immigration

There are about 8,600 Haitian migrants remaining under the Del Rio International bridge in Texas, waiting to be processed by immigration officials and possibly removed from the country. That\xe2\x80\x99s down from a high of about 14,000 earlier in the week, but there are still tens of thousands of other Haitian refugees further south, still waiting for a chance to enter the US. There are up to 30,000 Haitians in Colombia who may be seeking to travel north, and Panama expects 80,000 migrants to cross its borders by the end of this year. South and Central American leaders have expressed concern at the unprecedented flow of migrants. More than 97% of Haitians migrating to the US do not come directly from Haiti, but rather were residents of other countries first. Many Haitians trying to enter the US are believed to have been living elsewhere since the devastating Haiti earthquake in 2010.

The accusations of sexual harassment and abuse became the STANDARD POLITICAL WEAPON. I think it is used as such in the #GymnastsSexScandal. FBI has other and much more important problems to deal with, first of all their apparent inefficiency in National Security matters, and these issues should be discussed in Congress, not this blown out of all proportions sexy-sporty-medical diversion, supplied by the New Abwehr-KGB.
Use of sex scandals in politics
Leftists have a time honored tradition of controlling the state security structures and communications. The #GymnastsSexScadal if it is the plan to control the FBI, fits into this pattern. Obama's FBI abuses, well documented by the ACLU, also fit this pattern. These are the building blocks of the coming latent dictatorship of the Left.

There was no TSA to make us take off our shoes at airports. And the national debt was only $5 trillion \xe2\x80\x94\xc2\xa0compared with more than $28 trillion today.

We have been told that the criminal attacks of Sept.\xc2\xa011, 2001 \xe2\x80\x94 whose terrible anniversary was observed last week \xe2\x80\x94 "changed everything." But what really changed everything was the U.S. government\'s disastrous response to them.\xc2\xa0

That response was not preordained or inevitable, but the result of decisions and choices made by politicians, bureaucrats and generals who fueled and exploited our fears, unleashed wars of reprehensible vengeance and built a secretive security state, all thinly disguised behind Orwellian myths of American greatness.\xc2\xa0\xc2\xa0

Most Americans believe in democracy and many regard the United States as a democratic country. Ferencz compared this to the actions of the German leaders he prosecuted at Nuremberg, who also justified their invasions of other countries as "preemptive first strikes."\xc2\xa0

And thus the so-called Global War on Terror fueled a global explosion of terrorism and armed resistance that will never end \xe2\x80\x94 unless and until the United States ends the state terrorism that provokes and fuels it.\xc2\xa0

By opportunistically exploiting 9/11 to attack countries that had nothing to do with it, like Iraq, Somalia, Libya, Syria and Yemen, the United States vastly expanded the destructive strategy it used in the 1980s to destabilize Afghanistan, which spawned the Taliban and al-Qaida in the first place.

In Libya and Syria, only 10\xc2\xa0years after 9/11, U.S. leaders betrayed every American who lost a loved one on Sept.\xc2\xa011\xc2\xa0by recruiting and arming al-Qaida-led militants to overthrow two of the most secular governments in the Middle East, plunging both countries into years of intractable violence and fueling radicalization throughout the region.

The U.S. response to 9/11 was corrupted by a toxic soup of revenge, imperialist ambitions, war profiteering, systematic brainwashing and sheer stupidity. The only Republican senator who voted against the war on Iraq, Lincoln Chafee, later wrote, "Helping a rogue president start an unnecessary war should be a career-ending lapse of judgment."

But it wasn\'t. Very few of the 263 Republicans or the 110 Democrats who voted for the Iraq war in 2002 paid any political price for their complicity in international aggression, which the judges at Nuremberg explicitly called "the\xc2\xa0supreme international crime." One of them now sits at the apex of power in the White House.\xc2\xa0

Donald Trump and Joe Biden\'s withdrawal and implicit acceptance of the U.S. defeat in Afghanistan could serve as an important step toward ending the violence and chaos their predecessors unleashed after the 9/11\xc2\xa0attacks. But the current debate over next year\'s military budget makes clear that our deluded leaders are still dodging the obvious lessons of 20 years of war.\xc2\xa0

Barbara Lee, the only member of Congress with the wisdom and courage to vote against Congress\'\xc2\xa0war resolution in 2001, has introduced a bill to cut U.S. military spending by almost half:\xc2\xa0$350 billion per year. With the miserable failure in Afghanistan \xe2\x80\x94\xc2\xa0a war that will end up costing every U.S. citizen $20,000 \xe2\x80\x94\xc2\xa0one would think that Lee\'s proposal would elicit\xc2\xa0tremendous support. But the White House, the Pentagon and the Armed Services Committees in both the\xc2\xa0House and Senate are instead falling over each other to shovel even more money into the bottomless pit of the military budget.

Politicians\' votes on questions of war, peace and military spending are the most reliable test of their commitment to progressive values and the well-being of their constituents. You cannot call yourself a progressive or a champion of working people if you vote to appropriate more money for weapons and war than for health care, education, green jobs and fighting poverty.
\n
These 20 years of war have revealed to Americans and the world that modern weapons and formidable military forces can only accomplish two things: They can kill and maim people, and they can destroy homes, infrastructure and entire cities. American promises to rebuild bombed-out cities and "remake" countries it has destroyed have proven worthless, as Biden has\xc2\xa0acknowledged.\xc2\xa0

Both\xc2\xa0Iraq and\xc2\xa0Afghanistan are turning primarily to China for the help they need to start rebuilding and developing economically from the ruin and devastation left by America and its allies. America destroys, China builds. The contrast could not be more stark or self-evident. No amount of Western propaganda can hide what the whole world can see.\xc2\xa0
\n
But the different paths chosen by U.S. and Chinese leaders are not predestined, and despite the intellectual and moral bankruptcy of the U.S. corporate media, the American public has always been wiser and more committed to cooperative diplomacy than America\'s political and executive class. It has been\xc2\xa0well-documented that many of the endless crises in U.S. foreign policy could have been avoided if America\'s leaders had just listened to the public.

The perennial handicap that has dogged America\'s diplomacy since World War II is precisely our investment in weapons and military forces, including nuclear weapons that threaten our very existence. It is trite but true to say that\xc2\xa0when the only tool you have is a hammer, every problem looks like a nail.
\n
Other countries don\'t have the option of deploying overwhelming military force to confront international problems, so they have had to be smarter and more nimble in their diplomacy, and more prudent and selective in their more limited uses of military force.\xc2\xa0
\n
The rote declarations of U.S. leaders that "all options are on the table" are a euphemism for precisely the "threat or use of force" that the\xc2\xa0UN Charter explicitly prohibits, and they stymie the U.S. development of expertise in nonviolent forms of conflict resolution. The\xc2\xa0bumbling and bombast of America\'s leaders in international arenas stand in sharp contrast to the skillful diplomacy and clear language we often hear from top\xc2\xa0Russian,\xc2\xa0Chinese and\xc2\xa0Iranian diplomats, even when they are speaking in English, their second or third language.
\n
By contrast, U.S. leaders rely on threats, coups, sanctions and war to project power around the world. They promise Americans that these coercive methods will maintain American "leadership" or dominance indefinitely into the future, as if that were\xc2\xa0America\'s rightful place in the world, to be\xc2\xa0sitting atop the globe like a cowboy on a bucking bronco.\xc2\xa0
\n
A "New American Century" and "Pax Americana" are Orwellian versions of Hitler\'s "Thousand-Year Reich," but are no more realistic. No empire has lasted forever, and there is historical evidence that even the most successful empires have a lifespan of no more than\xc2\xa0250 years, by which time their rulers have enjoyed so much wealth and power that decadence and decline inevitably set in. This describes the United States today.\xc2\xa0\xc2\xa0
\n
America\'s economic dominance is waning. Its once productive economy has been gutted and\xc2\xa0financialized, and most countries in the world now do\xc2\xa0more trade with China and/or the European Union than with the United States. Where America\'s military once kicked open doors for American capital to "follow the flag" and open up new markets, today\'s U.S. war machine is just a bull in the global china shop, wielding purely destructive power.\xc2\xa0\xc2\xa0\xc2\xa0\xc2\xa0

But we are not condemned to passively follow the suicidal path of militarism and hostility. Biden\'s withdrawal from Afghanistan could be a down payment on a transition to a more peaceful post-imperial economy \xe2\x80\x94 if the American public starts to actively demand peace, diplomacy and disarmament, and finds ways to make its\xc2\xa0voices heard.\xc2\xa0

We must get serious about demanding cuts in the Pentagon budget. None of our other problems will be solved as long as we keep allowing our leaders to flush the majority of federal discretionary spending down the same military toilet as the $2.26 trillion they wasted on the war in Afghanistan. We must oppose politicians who refuse to cut the Pentagon budget, regardless of which party they belong to and where they stand on other issues. Our organization, CODEPINK, is part of a new coalition to "Cut the Pentagon for the people, planet, peace and a future."

We must not let ourselves or our family members be recruited into the U.S. war machine. Instead, we must challenge our leaders\' absurd claims that the imperial forces deployed across the world to threaten other countries are somehow, by some convoluted logic, defending America. As one\xc2\xa0translator paraphrased Voltaire, "Whoever can make you believe absurdities can make you commit atrocities."\xc2\xa0\xc2\xa0

We must expose the ugly, destructive reality behind our country\'s myths of "defending U.S. vital interests," "humanitarian intervention," "the war on terror" and the latest absurdity, the ill-defined "rules-based order" whose rules only apply to others \xe2\x80\x94 never to the United States.\xc2\xa0

We must oppose the corrupt power of the arms industry, including U.S. weapons sales to the world\'s most repressive regimes and an unwinnable arms race that risks a potentially world-ending conflict with China and Russia.\xc2\xa0

Our only hope for the future is to abandon the futile quest for hegemony and instead commit to peace, cooperative diplomacy, international law and disarmament. One of the recurring patterns of the U.S. intelligence community\xe2\x80\x99s response to emerging threats is that it is often reactionary. Being caught unaware of the urgency of a new danger results in a pendulum swing: creating new priorities, policies, and procedures to correct those gaps. This is to be expected. After all, intelligence agencies \xe2\x80\x93 while designed to respond rapidly to discrete events \xe2\x80\x93 are, policy-wise, bureaucracies that are like large, slow-moving ships. Turning them around can take some time and effort, but once they face a new direction, they can barrel full speed ahead. Our multi-decade response to 9/11 is a classic example of both the resilience of the intelligence community even after a massive failure, but also how this reactionary approach set us up to repeat the cycle of missing other emerging threats over the horizon \xe2\x80\x93 particularly with Russia and domestic terrorism.
\n
In its report, the 9/11 Commission concluded that the successful arrest and prosecution of the perpetrators of the first bombing of the World Trade Center in 1993 \xe2\x80\x9chad the side effect of obscuring the need to examine the character and extent of the new threat facing the United States.\xe2\x80\x9d In particular, the FBI\xe2\x80\x99s focus on its reactive, law enforcement function \xe2\x80\x93 which resulted in tangible and visible credit to the agency and specific field offices \xe2\x80\x93 took precedence over forward-looking counterintelligence and counterterrorism efforts, which had fewer immediate returns. For the CIA, the end of the Cold War led to significant budget cuts after 1992 \xe2\x80\x93 the report notes that in 1995, for example, the agency hired only 25 new officers. Without the unifying focus of the Cold War, the CIA\xe2\x80\x99s mission seemed unclear and adrift; the Commission observed that the CIA found it difficult to adapt to a world without a clear adversary, and that its Cold War resources were either unable to be prudently reallocated or were diluted among too many different priorities.\xc2\xa0

John Sipher, a 25-year veteran CIA officer who served in Moscow, notes that the disconnect was also rooted in administration priorities. \xe2\x80\x9cAmong the national security agencies, the CIA is immediately responsive to the needs and interests of the White House,\xe2\x80\x9d Sipher emphasizes. \xe2\x80\x9cThe lack of interest in foreign policy for much of the Clinton Administration left the Agency to make do as best it could. It tried to anticipate policymaker interest by reading tea leaves \xe2\x80\x93 not the best way to provide tailored intelligence.”

The events of 9/11 changed all of this. The FBI, for its part, bore the brunt of the 9/11 Commission\xe2\x80\x99s criticisms but, thanks to the leadership of then-Director Robert S. Mueller III, avoided having its intelligence function severed from its law enforcement one. Along with legislative changes like the USA PATRIOT Act which made it easier to engage in foreign intelligence surveillance, increased funding for hiring new agents, and awarding \xe2\x80\x9cstats\xe2\x80\x9d for field offices pursuing terrorism related cases, the Bureau made immediate, if incremental, progress toward a comprehensive and consistent counterterrorism effort across its 56 field offices. (One particularly emblematic expression of this shift was in the ongoing case simulation at Quantico, which at the time was a bank robbery investigation \xe2\x80\x93 my new agent class was one of the first to work on a terrorism angle incorporated into the scenario.) Similarly, the CIA had clearer intelligence collection priorities following 9/11, and increased its intelligence sharing through coordination by the newly-created Director of National Intelligence.
\n
To be sure, the intense focus on preventing another terror attack on American soil was effective in thwarting many plots in motion. From the 2002 arrest of Jose Padilla, who planned to build and detonate a dirty bomb, to the disruption in 2009 of an al-Qaeda plot to bomb the New York City subway, there is no doubt that the intelligence community learned many of the tragic lessons outlined in the 9/11 Commission Report and acted to ensure they never happened again. But this pendulum swing, while necessary, also went too far in several respects, legally and morally, including the warrantless surveillance of Americans (over the early objections of the Justice Department) under STELLAR WIND and the use of enhanced interrogation techniques (including torture) on prisoners at Guantanamo and Abu Ghraib.

These excesses were ultimately exposed and generally corrected, but the longer term consequence of the constant government and media focus on preventing another 9/11 is that it blinded us to two of the major threats which currently pose an existential threat to democracy.\xc2\xa0
\n
The first is Russia. The end of the Cold War, and the belief that we had \xe2\x80\x9cwon,\xe2\x80\x9d obscured the growing threat posed by Moscow and even made it easier for the Kremlin to operate inside the United States. Even after the arrest of 10 Russian \xe2\x80\x9cillegals\xe2\x80\x9d in 2010 \xe2\x80\x93 spies operating without diplomatic cover \xe2\x80\x93 the threat from Russia was treated as a punchline, rather than a serious threat. Case in point: After Mitt Romney identified Russia, not al-Qaeda, as the biggest geopolitical foe to the United States, then-President Barack Obama launched a zinger at the 2012 presidential debate: \xe2\x80\x9cThe 1980s are now calling to ask for their foreign policy back.\xe2\x80\x9d
\n
More importantly, this posture shaped the public\xe2\x80\x99s perception of what constituted a foreign \xe2\x80\x9cthreat\xe2\x80\x9d to the homeland. To wit: If it wasn\xe2\x80\x99t connected to the Middle East, and involving explosions and dead bodies, it wasn\xe2\x80\x99t really dangerous. This outlook came to haunt the United States in 2016, when evidence of Russia\xe2\x80\x99s disinformation operation in the presidential election came to light. It became apparent that, at least for some people, Russia\xe2\x80\x99s interference only mattered if it ended up affecting the final vote. The lack of evidence that it did so (something that would be difficult to prove, since Russia\xe2\x80\x99s effort was ultimately a psychological operation) resulted in ambivalence and partisanship over the level of response required. Consider, by contrast, how even unsuccessful terrorist attempts which resulted in no casualties, like Richard Reid\xe2\x80\x99s failed \xe2\x80\x9cshoe bomb,\xe2\x80\x9d led to onerous security measures in airports \xe2\x80\x93 ones that are still in place, over a decade later. What\xe2\x80\x99s more, in the years that followed the Russian military intelligence\xe2\x80\x99s 2016 attack on the United States, Americans identifying with President Donald Trump\xe2\x80\x99s party increasingly warmed toward Putin and believed Russia was less of a critical threat. The basis for that outcome was laid before Trump stepped into office in part because the U.S. government had not oriented itself or the American public toward understanding the true nature of the danger posed by Russia.

This myopic focus on Islamic terrorism also eclipsed the growing threat of white nationalist terrorism and militia movements in the United States. If there was a missed through-line from the 1993 World Trade Center bombing to 9/11, there was another one between Oklahoma City and January 6. As Professor Kathleen Belew, a leading expert on white nationalism, has written, the declaration of war by the far right on the U.S. government reached its pinnacle in 1995 with the bombing of the Alfred P. Murrah federal building, and presaged the goals of the movement today. For a brief moment, at least, the \xe2\x80\x9cface\xe2\x80\x9d of terrorism was represented by Timothy McVeigh, who at that point was the perpetrator of the worst mass casualty event on American soil since Pearl Harbor. But as Belew also carefully documents, it was not understood how McVeigh connected up with the white power movement at the time.\xc2\xa0\xc2\xa0
\n
After 9/11, the popular imagination was transfixed by Osama bin Laden and his transnational network, as government resources shifted decisively toward foreign terrorism. We should question whether the intelligence failure preceding January 6 was caused, at least in part, by the fact that the people in attendance didn\xe2\x80\x99t \xe2\x80\x9clook\xe2\x80\x9d like terrorists or what one counterterrorism expert referred to as the \xe2\x80\x9cinvisible obvious\xe2\x80\x9d in which decision-makers and analysts failed to see the threat from people who looked liked them. (This last point also mirrors another post 9/11 issue: The intelligence gaps created by a lack of diversity in our intelligence community.)
\n
Fortunately, we have slowly come to terms with these new threats from Moscow and from within. In the previous Congress, the Senate Select Committee on Intelligence investigated and prepared a five-volume bipartisan report on Russian active measures and 2016 election interference, and the Office of the Director of National Intelligence provided a comprehensive intelligence assessment on foreign interference in the 2020 election to the President and Congress on January 7, 2020 and to the public on March 15, 2020. On the domestic terrorism front, last June the National Security Council issued its National Strategy for Countering Domestic Terrorism, which includes many of the measures taken in the post-9/11 context, including enhancing information sharing among agencies and increasing resources to investigate, prosecute, and track domestic terrorism. Also like after 9/11, Congress has now undertaken its own investigation through its bipartisan select committee looking into the events leading up to January 6, and the Justice Department is at least vigorously pursuing the foot soldiers.
\n
Twenty years after 9/11, we can be sure that U.S. policies, priorities, and resources will rise to meet the new challenges we face on foreign and domestic fronts. But, it is worth noting that we are once again responding from a reactionary posture to two of those major threats, suggesting that there are still lessons to be learned from the way the United States bounced back 20 years ago. For one, we need to ensure that the pendulum swing does not overcorrect, as it did with countering Islamic terrorism, to justify illegitimate and unlawful means to an end. We must also remember that as large as these current threats loom now, they won\xe2\x80\x99t last forever and may even evolve or be eclipsed by others. Hopefully the next time around, we won\xe2\x80\x99t miss the warnings.

The national security landscape has significantly changed since the advent of intelligence oversight, roughly 45 years ago. Our senior-most civil liberties oversight bodies must catch up. Specifically, the President’s Intelligence Oversight Board (PIOB) and the Privacy and Civil Liberties Oversight Board (PCLOB) should be combined into a single White House civil liberties and compliance office, with an expanded mission, independent of the federal agencies it oversees, but responsive to the President. This new office should also be purposed for maximum transparency with both Congress and the public. To buttress this proposal, some background and context on the institutional development of intelligence oversight is helpful.
\n
Intelligence oversight within the executive branch has been largely shaped by legislation and presidential orders tied to two major events: the CIA, FBI, and NSA infringement on Americans\xe2\x80\x99 civil liberties in the 1960s-1970s, and the more recent 9/11 terrorist attacks. Due to federal government surveillance abuses, in 1975, Congress established two select committees, the Pike Committee in the House and the and Church Committee in the Senate, to oversee the intelligence community. These committees subsequently became the House Permanent Subcommittee on Intelligence (HPSCI) and the Senate Select Committee on Intelligence (SSCI). Both committees determined that the executive branch had spied on civil rights activists and anti-Vietnam War protestors\xe2\x80\x99 domestic activities through such intrusive means as unconstitutional wiretaps and then attempted to cover up the wrongdoing.
\n
In response, Congress passed a series of laws (including the Foreign Intelligence Surveillance Act, the Inspector General Act of 1978, and the Intelligence Authorization Act for Fiscal Year 1981) to more effectively regulate intelligence agencies and activities that might infringe upon the rights of U.S. persons. Presidents Ford, Carter, and Reagan also issued a series of executive orders (E.O.s 11905, 12036, 12333, and 12334) that added significant executive branch controls and reporting requirements on the conduct of all intelligence activities, including covert action.
\n
To avoid White House leadership being caught off-guard by future intelligence community mishaps, President Ford established an Intelligence Oversight Board (IOB) in 1976, which through subsequent administrations was moved under the President\xe2\x80\x99s Intelligence Advisory Board (PIAB), but still located within the executive office of the president (EOP) and became known as the President\xe2\x80\x99s Intelligence Oversight Board (PIOB). The PIOB serves as a direct report to the President on intelligence matters. It is chiefly a compliance body and its primary function is to inform the President of intelligence activities that the PIOB believes may be unlawful or contrary to E.O. or presidential directive or impugn the reputation of the intelligence community.
\n
The last update to the PIOB charter was in 2008, when President Bush issued E.O. 13462. It directs: “the [P]IOB shall consist of not more than five members of the PIAB who are designated by the President from among members of the PIAB to serve on the [P]IOB.” In addition, the PIOB has a small but compensated professional staff. Aside from a PIOB executive-director, members of the PIOB serve on a part-time basis, without compensation. Each federal agency that conducts intelligence activities is required to submit a quarterly compliance report to the PIOB. See here for a sample of redacted and publicly released quarterly NSA compliance reports submitted to the PIOB.
\n
As for the PCLOB, the 9/11 Commission Report recommended its establishment. It was created through the Intelligence Reform and Terrorism Prevention Act of 2004, and subsequently made into an independent executive branch agency by the 9/11 Commission Act. The PCLOB has a narrow purpose:
\n
(1) analyze and review actions the executive branch takes to protect the Nation from terrorism, ensuring that the need for such actions is balanced with the need to protect privacy and civil liberties; (2) and ensure that liberty concerns are appropriately considered in the development and implementation of laws, regulations, and policies related to efforts to protect the Nation against terrorism.
\n
The PCLOB is composed of a compensated, full-time chairman and four compensated, part-time members. All members are appointed by the President and require consent of the Senate. Additionally, the PCLOB has a staff composed of an executive director, a general counsel, staff attorneys, and administrative support.
\n
Blind Spot I: Non-Intelligence Activities
\n
National Security Council (NSC) staff or other White House officials overseeing civil liberties and compliance within the intelligence community should also be aware of and receive reports of non-intelligence national security activities that carry commensurate privacy, civil liberties, and reputational or political risk to intelligence activities. The term \xe2\x80\x9cintelligence activities\xe2\x80\x9d is defined as \xe2\x80\x9call activities that elements of the intelligence community are authorized to conduct pursuant to [E.O. 12333].\xe2\x80\x9d Additionally, intelligence activities are conducted for a foreign intelligence (FI) or counterintelligence (CI) purpose.
\n
Unfortunately, there is a glaring gap in the oversight of non-intelligence national security activities.\xc2\xa0 The Department of Defense (DoD) in particular has increased its capacity to conduct a host of high-risk and politically sensitive non-intelligence activities such as cyberspace operations, battlespace awareness, operational preparation of the environment, information operations, and insider-threat/security monitoring that are less regulated and ripe for non-compliance. Additionally, while sometimes these activities are coordinated with the NSC\xe2\x80\x99s counterterrorism directorate (or other relevant directorates), or even approved at the presidential level in some administrations, the back-end reporting to the White House on operations that go awry is not formalized in statute or executive order. Therefore, these non-intelligence activities, especially the ones that are particularly sensitive, need a formalized reporting channel into the White House when they violate law, E.O., policy, or impugn the reputation of the government.
\n
Consider a hypothetical of a non-intelligence activity: an information operations analyst, working at Special Operations Command, uses a powerful open-source tool kit, such as Babel Street, without authorization, intentionally builds a dossier that aggregates intimate details of a U.S. citizen, perhaps even a member of Congress or a domestic, civil-society organization, like the ACLU. This activity is clearly improper, and could be investigated by the DoD inspector general, for example, but intelligence oversight rules do not apply. Because the abuse was not conducted by intelligence personnel \xe2\x80\x94 or under intelligence authorities, or for an FI or CI purpose \xe2\x80\x94 the violation would not be required to be reported to the PIOB, potentially leaving senior White House officials ill-informed and unable to respond to an egregious civil liberties concern. What\xe2\x80\x99s more, such a lack of comprehensive oversight could also reduce public confidence in our institutions and adversely impact foreign relations if the incident also involves allies or foreign partners.
\n
Blind Spot II: Non-Counterterrorism Activities
\n
As mentioned above, the PCLOB has a singular terrorism focus. However, there are a host of other national security activities that jeopardize both privacy and civil liberties outside the PCLOB\xe2\x80\x99s mandate. Examples of these types of activities include the recent Department of Homeland Security and U.S. Postal Service (USPS) domestic surveillance of civil rights and anti COVID-19 restrictions protestors, questionable counterintelligence programs at the Department of Commerce, and the FBI surveillance of Chinese-Americans.
\n
Furthermore, two current PCLOB members stated that they look forward to future work on \xe2\x80\x9cthe use of new and enhanced technologies to support counterterrorism activities, including facial recognition technology, artificial intelligence, information technology vulnerabilities, responses to changes in encryption technology, and other surveillance mechanisms.\xe2\x80\x9d A concern with this statement is that many of these intrusive technologies that the government is considering using, or is already using, might not be in support of counterterrorism activities (or intelligence activities as defined above) but instead the plethora of other state security functions.
\n
A single organization should analyze and review all U.S. government surveillance activities, laws, regulations and policies, regardless of whether they are counterterrorism-focused, to ensure they are properly balanced with the need to protect privacy and civil liberties.
\n
Policy Proposal:\xc2\xa0 Establish a White House Privacy, Civil Liberties and Compliance Office
\n
To bridge these gaps, the President should create a White House senior director or similar position that reviews both intelligence activities and sensitive non-intelligence national security activities for privacy, civil liberties, and compliance concerns.
\n
This proposed reform would likely require the President to work with Congress to expand the scope and mission of the PCLOB and PIOB and merge them into this newly-formed White House civil liberties oversight office located within the EOP and answering directly to the President. It is critical that this new office have sufficient resources to accomplish its mission. Both the PIOB and PCLOB are woefully understaffed; each office is authorized five members, most of whom are part-time government employees, and a small standing support staff. Due to these staffing shortages, the PCLOB took approximately five years to produce the underwhelming XKeyscore report. Moreover, for most of the PCLOB\xe2\x80\x99s short existence it has operated without the required member quorum to provide agency advice and publish reports.
\n
By statute, this office should be composed of no less than ten full-time and compensated civil liberties and compliance experts, and commensurate staff, detailed from national security agencies or hired directly from outside of government. In addition, the members should be Senate-confirmed and appointed for a five or seven-year term, similar to some of the inspectors general in executive branch agencies.
\n
A merged entity would also ensure the quarterly compliance reviews like those currently conducted by the PIOB are undertaken beyond the intelligence realm, which would more effectively fulfill the PCLOB\xe2\x80\x99s own current oversight mission. PCLOB member Travis Leblanc highlighted this deficiency when he criticized that the PCLOB has displayed an \xe2\x80\x9cunwillingness to probe into any possible issues of compliance\xe2\x80\x9d during the recently published report on the National Security Agency\xe2\x80\x99s XKeyscore program.

Conclusion
\n
Within the executive branch, independence comes in many degrees. Within DoD, for example, it ranges from a highly-independent statutory inspector general like the DoD IG that isn’t subordinate to the Secretary of Defense, to the less independent Assistant to Secretary of Defense for Intelligence Oversight, who reports to the Secretary, yet is still independent from the intelligence bureaucracy he oversees. Beyond the executive branch, there are legislative oversight bodies, like the HPSCI, SSCI, and GAO, that exercise complete independence. The question is where to strike the balance.
\n
The President needs a top civil liberties and compliance official whose office is independent from the federal agencies it oversees but still responsive to the President\xe2\x80\x99s priorities and advisory needs. Therefore, the administration should ideally work with Congress to ensure that the progeny of the PCLOB/PIOB has the right grade of independence, a broad but clear mandate, and the resources to match. The Biden Administration should also allay congressional concerns over a less independent civil liberties official by offering increased transparency. All reports produced by this office should be shared with the congressional oversight committees and, to the extent possible, redacted for public release. This should be a central part of the trade-off.

Without such oversight reforms, White House leadership is at risk of lacking the necessary insights to weigh critical national security costs and benefits and make informed decisions to protect the constitutional rights of all Americans.

As Joe Biden and Kamala Harris took their oaths of office last week, it was revealed that FBI Deputy Director David Bowdich will be\xc2\xa0retiring\xc2\xa0soon. Paul Abbate, the FBI No.\xc2\xa03, will be promoted from associate deputy director to Bowdich\'s post.
\n
At least for the moment, Joe Biden has left Christopher Wray as FBI chief \xe2\x80\x94 partly in deference to the bureau\'s supposed independence, and also because on the face of it Wray doesn\'t look like a Trump guy. Both before and after\xc2\xa0the election, Donald Trump was said many times to\xc2\xa0be\xc2\xa0on the verge of firing Wray. But that was only because the FBI director\xc2\xa0did not yield to the outgoing president\'s most extreme, extravagant and baseless requests \xe2\x80\x94\xc2\xa0such as indicting Barack Obama and Biden\xc2\xa0over absolutely nothing \xe2\x80\x94\xc2\xa0and doesn\'t mean Wray should stay on.
\n
Bowdich\'s early retirement and departure is likely linked to the Capitol events\xc2\xa0and the perception of FBI inaction toward\xc2\xa0far-right terrorism, an issue I have raised in more general terms in a previous\xc2\xa0Salon\xc2\xa0article. A lapse as grievous as we saw on Jan. 6\xc2\xa0is hardly due to incompetence at that level. We are most likely talking about bias.
\n
This is why, as a top priority, Vice President Harris should put her lawyer hat on once again and lead, together with Congress, a reform of the FBI legal standards on terrorism, as they are\xc2\xa0applied to the progressive left and\xc2\xa0the far right.
\n
The Capitol attack was not an unpredictable, once-in-a-lifetime "black swan" event. It was\xc2\xa0part of a pattern. It\'s not like a meteor hit Washington out of nowhere. These right-wing groups are well known, and closely followed by the FBI.
\n
Ahead of the elections, FBI agents themselves competently and timely foiled the plot by far-right militias to kidnap and assassinate Michigan Gov.\xc2\xa0Gretchen\xc2\xa0Whitmer. The FBI agents that did that did not need\xc2\xa0a publicly organized event that was all over the media and Twitter to tell them what might happen. This indicates that\xc2\xa0FBI agents and analysts in the field get it right \xe2\x80\x94\xc2\xa0when the top leadership doesn\'t put the brakes on them, that is. The people who entered the Capitol had similar plans for any number of politicians and lawmakers.\xc2\xa0There is evidence appearing now through the courts that the Trump mob indeed intended to capture and assassinate members of Congress, as detailed in a recent\xc2\xa0court\xc2\xa0filing\xc2\xa0by federal prosecutors.\xc2\xa0The FBI knows these\xc2\xa0groups and their\xc2\xa0intentions.

In a press conference several days after the events, FBI officials informed the public that they needed to differentiate between "keyboard bravado" and actual intentions. Keyboard bravado is the new "locker-room talk."\xc2\xa0The FBI gave terrorism practices and terrorism preparations par excellence the benefit of the doubt, but have a pronounced tendency to crack\xc2\xa0down on practices which are far away from terrorism when it comes to the progressive left.

The FBI has traditionally been known for its repression of left or progressive\xc2\xa0activis,, as an Intercept article\xc2\xa0explores\xc2\xa0and as a new documentary film about the FBI\'s treatment of the Rev. Martin Luther King Jr. shows.
\n
In the spring of last year, when I was\xc2\xa0a candidate for the office of UN special rapporteur on freedom of speech, Bowdich was quoted, in a memo leaked to the New York Times,\xc2\xa0reacting to the nationwide wave of Black Lives Matters protests. Bowdich maintained that the protesters should be arrested under an outdated racketeering law from the 1940s. The leaked memo showed that Bowdich considered the social justice movement "a national crisis" comparable to 9/11. The hundreds of thousands of people mourning and marching across the country, unified by the simple concept\xc2\xa0that no life should be taken lightly,\xc2\xa0were seen by the FBI\'s deputy director as similar to terrorists or members of organized crime operations.
\n
To say\xc2\xa0that protesters who\xc2\xa0clash\xc2\xa0with the police are like terrorists\xc2\xa0is like saying that a car crash at the traffic light\xc2\xa0is a suicide bombing.\xc2\xa0Recently I\xc2\xa0wondered\xc2\xa0why Bowdich won\'t speak about\xc2\xa09/11 now, when we face the threat of actual\xc2\xa0far-right terrorism, including\xc2\xa0plans to blow up buildings and assassinate lawmakers.

The FBI remains obsessed with dissident or radical voices on the left,\xc2\xa0while largely ignoring the violent extremists and the real terrorism threat on the far right, as recently revealed by an\xc2\xa0Intercept\xc2\xa0investigation\xc2\xa0that\xc2\xa0found "glaring disparities between law enforcement\'s depiction of groups on the right and the left."

When it came to analysis of left-wing groups, "law enforcement intelligence was often vague, mixed up in online conspiracy theories or untethered to evidence of suspected criminal activity". When it comes to the right, on the other hand, the documents showed\xc2\xa0"law enforcement agencies across the country sharing detailed and specific information on the mobilization of armed groups looking to use the unrest as cover to attack law enforcement and protesters and set off a civil war."
\n
Harris, together with Congress, should lead a review and reform of the legal standards the FBI uses in opening terrorism investigations on progressives, Black activists,\xc2\xa0pro-bono lawyers,\xc2\xa0intellectuals and left-wing journalists, and review the standards for evidence of what constitutes suspicious criminal behavior, the thresholds for warrants, and other legal procedures. How easy is it to open terrorism investigations on progressives or leftists who have no prior criminal record and no suspicious criminal-group memberships?

It is past time to get to the bottom of this. As recent events should make clear, the progressive left is not the national security enemy.

The libertarian Cato Institute sued the FBI and Department of Justice on Thursday, vowing to unearth records about whether and when the FBI has overstepped its bounds in targeting and investigating American citizens.
The battle is unfolding amid concerns that FBI is choosing to investigate people because of politics and ideology instead of wrongdoing, with critics pointing to charges that the bureau targeted a conservative group for a probe while simultaneously ignoring U.S. gymnasts\xe2\x80\x99 allegations of sexual abuse by ex-Olympic gymnastics doctor Larry Nassar. \xc2\xa0
The think tank is seeking records to shed light on when the FBI thinks it has gone too far in investigating people who may not have been accused of a crime through various investigative activities such as so-called \xe2\x80\x9cassessments.\xe2\x80\x9d The sought-after records would reveal hidden details about whom the FBI investigated, in violation of its own rules and without producing evidence for doing so, Cato officials say. \xc2\xa0
\xe2\x80\x9cIf the FBI is allowed to continue to use assessments as a tool to investigate people without any kind of predicate, you\xe2\x80\x99re changing the fundamental fabric of the country, you\xe2\x80\x99re changing the fundamental relationship between the citizen and the government,\xe2\x80\x9d said Patrick Eddington, Cato Institute senior fellow. \xe2\x80\x9cAnd that\xe2\x80\x99s the kind of insidious, creeping change that is the most difficult to try to deal with.\xe2\x80\x9d
FBI\xe2\x80\x98s assessments to probe individuals and groups\xe2\x80\x99 actions do not require allegations of wrongdoing or a \xe2\x80\x9cfactual predication,\xe2\x80\x9d instead only needing an \xe2\x80\x9cauthorized purpose\xe2\x80\x9d and a clear objective, according to the FBI\xe2\x80\x98s Domestic Investigations and Operations Guide updated in 2016.
A wide variety of politically oriented groups have already been swept up in FBI assessments, according to records obtained by Mr. Eddington, including the conservative Concerned Women for America, a New York chapter of the League of Women Voters, and the Muslim Justice League in Massachusetts.\xc2\xa0
The Cato Institute asked the FBI last fall for records regarding when federal agents thought the FBI failed to follow its own requirements for conducting domestic investigations and operations. The FBI answered this summer that it had nearly 1,100 pages of such records and releasing the information would take approximately five-and-a-half years, according to the Cato Institute\xe2\x80\x99s lawsuit.\xc2\xa0
Mr. Eddington said Thursday\xe2\x80\x99s Freedom of Information Act lawsuit marks Cato\xe2\x80\x99s 11th suit against the FBI or the Justice Department since 2019. He said he thinks the bureau is purposefully moving slowly to protect the FBI\xe2\x80\x98s reputation.\xc2\xa0
\xe2\x80\x9cAlmost 1,100 pages sounds like a lot until you realize that they told me via email that it only covers a period \xe2\x80\x94 2013 to 2020, essentially,\xe2\x80\x9d Mr. Eddington said. \xe2\x80\x9cWhat about everything before that? What kind of supposed oversight was taking place? And I have to say the entire idea of internal oversight at any agency or department, I find laughable.\xe2\x80\x9d
The nearly 1,100 pages of records involve the FBI\xe2\x80\x98s internal discussion of its own methods and would not include instances of the FBI conducting assessments of groups that watchdogs and Americans may find objectionable.\xc2\xa0
For example, the records may not include the FBI\xe2\x80\x98s examination of Concerned Women for America in 2016 conducted in part because of how Charity Navigator, a group that grades organizations, scored CWA, according to documents released to Mr. Eddington in response to a FOIA request. The FBI determined there was no reason to investigate the conservative women\xe2\x80\x99s group further.\xc2\xa0
The revelation that the FBI probed the conservative women\xe2\x80\x99s group in the months before the 2016 presidential election spurred concern on Capitol Hill. Sen. Chuck Grassley, Iowa Republican, and Rep. Jim Jordan, Ohio Republican, each wrote letters to the FBI demanding answers about the investigation of the conservative women\xe2\x80\x99s group.\xc2\xa0
While no answers have yet become public, Republicans are working with the FBI and expect them to cooperate, according to a House Republican source.\xc2\xa0
Details about how the FBI chooses to launch investigations and which matters it prioritizes are receiving newfound scrutiny amid U.S. gymnasts\xe2\x80\x99 testimony this week during a Senate hearing regarding the FBI\xe2\x80\x98s handling of sexual abuse charges against Nassar. Gymnast McKayla Maroney testified that she told an FBI agent in the summer of 2015 about the abuse she suffered but she said it was not documented until 17 months later.\xc2\xa0
While FBI agents in one field office allegedly ignored Ms. Maroney, a different FBI field office probed Concerned Women for America and found nothing worth pursuing.\xc2\xa0
Mr. Grassley referenced the Nassar investigation in his July letter to FBI over its examination of Concerned Women for America.
\xe2\x80\x9cBased on the unredacted information that\xe2\x80\x99s been made public to date, I\xe2\x80\x99m concerned about the basis upon which the FBI initiated an assessment of CWA and the authorities it relied on to do so,\xe2\x80\x9d wrote Mr. Grassley in the letter. \xe2\x80\x9cUnfortunately, as the country has witnessed in the recent past, including the Crossfire Hurricane investigation and the Larry Nassar investigation, the FBI has repeatedly failed in its mission and abused its authority.\xe2\x80\x9d
The FBI declined to comment. The FBI\xe2\x80\x99s Washington Field Office previously declined to comment on its assessment of Concerned Women for America and directed The Washington Times to the information it released under the FOIA request to Mr. Eddington.
