He said that the area had not been cordoned off.</p><p>The 67-year-old retired pensioner was pulled from the drain by his brother and nephews and brought to St John’s Hospital where he had an x-ray.</p><p>Six days later, he was still in pain and went to the Regional Hospital in Dooradoyle where he was&nbsp;prescribed pain killers after a right rib fracture was diagnosed.</p><p>He couldn’t lift his grandchildren for some time after the fall and that had tenderness but now, seven years after the accident, he was “grand again”.</p><p>Under cross-examination, he said he had seen the open manhole but forgot about it as he turned to walk back to his house and he fell in.</p><p>Mr Casey brought his personal injury action against Limerick City Council, who were responsible for the halting site; &nbsp;Hazdecon Ltd, trading as Premier Drain Cleaning and Joebren Limited, caretakers of the halting site.</p><p>Counsel for the City Council Derek Sheahan BL, said a statutory defence had been filed which indemnified the local authority from any liability.</p><p>Mr Sheahan argued that, as Premier Drain Cleaning were a specialist company, they were responsible for any claim.</p><p>However, when Judge Keys asked why Premier Drain Cleaning was not represented, Mr Casey’s barrister, Philip Moloney BL, said the company had been dissolved one month before the accident.</p><p>Hazdecon Ltd was also recorded as “dormant” on August 31, 2007, more than 15 months before the accident.</p><p>“Well, that paints a very different picture of your defence”, Judge Keys remarked to Mr Sheahan. “This isn’t a case of pass the buck”.</p><p>“We all know that if you are going to open a manhole, you have to have it fenced off or have someone standing there on duty.</p><p>“I cannot accept that as a defence,” he said to Mr Sheahan as the defence barrister sought to explain that the council felt they had employed a “competent specialist firm”.</p><p>“Yes but they company was liquidated a month beforehand and they didn’t do the job properly”, Judge Keys said.</p><p>“The contractor was not ‘Jim’ll fix it’, so we felt that the matter was properly in hand,” Mr Sheahan countered arguing that “we should not be liable over the negligence of the contractor.”</p><p>However, Judge Keys ruled that the contracted company was dissolved and Limerick City Council were responsible.”</p><p>After a brief want to see happen in the new year.</p><p>Issues pertaining to road repairs, congestion, drain cleaning and tourist harassment also surfaced as <b>The Gleaner</b> took to the streets of Ocho Rios recently.</p><p>One resident, Mark Thomas, said there were three main issues that need to be addressed urgently.</p><p>"For Ocho Rios, there are three main things - the cleanliness of the whole town; two, fewer homeless people and mad people on the streets; and three, the roads, especially in and around Ocho Rios. Those are the main things I want to see improved," Thomas said.</p><p>The issue of road repairs was partially addressed recently with patching exercise by National Works Agency. But according to another resident, Debbie Leeung, patching does not solve the problems being faced by motorists and pedestrians alike.</p><p>"When I say fix the road I don't mean do a little patch work because patch work doesn't help anybody, it's like a camouflage," Leeung says.</p><p>"If we take our time and do the thing right, let it last for a 10-year (period), I see where it would be a big improvement." For her, proper roads is the major concern.</p><p>A gentleman who gave his name as Tony decried the harassment of visitors, the street people and the drainage problem.</p><p>"The drainage system is pretty bad. Whenever it rains, the town is full of water on the street, and it doesn't run off easily. Then there are too many madmen on the streets and too many street boys," he pointed out.</p><p>"And the folks who interfere with the tourists, that puts a little fear in the tourists." Tony, who says he spends time abroad each year, says friends who visit Jamaica often complain to him about harassment.</p><p>"They would say, you have a lot of beggars in Ocho Rios, and I feel so ashamed really. Apart from that, Ochi stinks, it smells a lot. I don't know what the problem is, but it stinks."</p><p>Another gentleman, Baldie, says he hates to visit Ocho Rios when it rains as there is a lot of water running on the streets. Those are the main things I want to see improved," Thomas said.</p><p>The issue of road repairs was partially addressed recently with patching exercise by National Works Agency. But according to another resident, Debbie Leeung, patching does not solve the problems being faced by motorists and pedestrians alike.</p><p>"When I say fix the road I don't mean do a little patch work because patch work doesn't help anybody, it's like a camouflage," Leeung says.</p><p>"If we take our time and do the thing right, let it last for a 10-year (period), I see where it would be a big improvement." For her, proper roads is the major concern.</p><p>A gentleman who gave his name as Tony decried the harassment of visitors, the street people and the drainage problem.</p><p>"The drainage system is pretty bad. Whenever it rains, the town is full of water on the street, and it doesn't run off easily. Then there are too many madmen on the streets and too many street boys," he pointed out.</p><p>"And the folks who interfere with the tourists, that puts a little fear in the tourists." Tony, who says he spends time abroad each year, says friends who visit Jamaica often complain to him about harassment.</p><p>"They would say, you have a lot of beggars in Ocho Rios, and I feel so ashamed really. Apart from that, Ochi stinks, it smells a lot. I don't know what the problem is, but it stinks."</p><p>Another gentleman, Baldie, says he hates to visit Ocho Rios when it rains as there is a lot of water running on the streets. Under the project, a pilot sewage treatment plant (STP) will be set up and operated along the drain near Sarai Kale Khan with the support of the Dutch and the Indian consortium.</p> <p>Scientists from IIT, Delhi will be part of the project.</p> <p>The practical expertise generated through this pilot plant will focus on finding cost effective local solutions and adapt state-of-the-art Dutch technology to Indian conditions for the cleaning of the drain. I would never take children there.</p> <p>“It has to be costly to drain and fill, and with the water conservation issues this seems to not be a good use of funds,” she continued.</p> <p>“The bird/fowl population is out of control. It is an unhealthy place. Open space would allow for community gatherings such as music and events.”</p> <p>Hugo Aguilar politely disagreed, writing that the village green was designed for those bigger community gatherings.</p> <p>“Although I do agree,” he continued. “Frequently cleaning would make the park a better area to walk around.”</p> <p><b>ADOPT A SENIOR NEEDS VOLUNTEERS</b>Looking for a way to share the holiday spirit with those who might need a little extra cheer? Is your sink clogged — or slow slow slow? It is in moments like these that even the greenest among us might feel a need to use chemical drain cleaners. Yes they may contain sodium hydroxide, a caustic soda — but what other option is there besides calling a costly plumber? Are there <strong>eco friendly</strong>options available?</p><br /><h2>Eco friendly drain clog solutions</h2><br /><p>Invented by a master plumber, Drain-FX was created for situations like these, giving people without major plumbing skills the ability to clear their own plumbing blockages. It has the ability to clear most clogs in seconds, including food, sand, and fat. Drain-FX can also be used for regular home plumbing maintenance a couple times a year, removing debris thus preventing blockages from even occurring. Unfortunately, drain cleaners are often ineffective in removing the blockage and debris, especially when in more advanced stages.</p><br /><p>As the skull and crossbones on drain cleaners may indicate, they are poisonous and potentially unsafe with improper use. In fact, it can cause nasty chemical burns if it comes in contact with the skin or eyes and can create a hazardous gas if it comes into contact with other cleaning supplies or a different type of chemical drain cleaner. Such products should always be stored in a place that is not accessible to children or pets. Drain cleaning chemicals also enter into the sewer system and can end up in waterways, where they can hurt wildlife. In addition, many drain cleaners are highly corrosive and can harm your plumbing system (mostly commonly the drain trap), by causing them to deteriorate.</p><br /><div></div><br /><p>Slightly braver people than myself may try to clear blockages by removing the drain trap. This can be highly effective and is an <strong>eco friendly</strong> alternative to drain cleaners, but requires a higher level of skill and can be somewhat messy. A leak can develop under the sink if the trap is not properly assembled again and the drain blockage might be slightly further down, making this attempt unsuccessful. In such cases a drain snake is helpful in reaching father into the plumbing system to remove the blockage, but this can be somewhat time consuming and very messy. The advantage of Drain-FX and some other simple DIY methods is that blockages can be removed without taking the drain trap apart and will seem more approachable and therefore less intimidating to more people.</p><br /><h3>Other green DIY ways to clear drains</h3><br /><p>If you aren’t quite ready to spend $20 on Drain-FX and want to try some other <strong>eco friendly</strong> alternative, there are a few that might work.</p><br /><ul><br /><li>I’ve tried the vinegar and baking soda trick and had some luck removing debris, but not full blockages. Take about 1/2 cup of baking soda and pour about 1/2 of vinegar on top of it. Cover it with a drain plug (if you have one) as the combination fizzes. Let it sit for an hour or even overnight, then flush it with hot water or even boiling water.</li><br /><li>Another <strong>eco friendly </strong>trick that I’ve used to remove hair near the top of a clogged tub or shower drain is to take a simple wire hanger. Unbend it and make it as strait as possible. Insert it into the drain and pull hair and other debris out of the drain. Make sure you are removing the blockage and not pushing it back in. When you are done fishing out gunk, run the hot water and hopefully the drain will be clear.</li><br /></ul><br /><p>Next time you get ready to call the plumber or pour drain cleaner down the drain, remember other <strong>eco friendly</strong> options are available. Better yet, a bit of preventative plumbing maintenance a couple times a year can go a long way in clearing away debris to prevent clogs from forming. Use kitchen roll to wipe around the drain of your sink or bath, removing any bits of food or collections of hair.</li><br /><li>Mix together the baking soda, salt, and cream of tartar in a small container. The salt and baking soda work together to help scour pipes and break up buildup, while the cream of tartar naturally cleans metals. Shake the mixture and sprinkle half down the clogged drain.</li><br /><li>Pour in the boiling water and let the drain buster work its magic for about an hour. Then rinse with cool water. You should notice a difference in your drainage.</li><br /><li>If the drain still is still clogged, get serious by pouring 220g of baking soda down the drain followed with 250ml vinegar. The two create a fizzing reaction, which will attack nasty obstructions. Allow the baking soda and vinegar to work overnight, and then pour two cups boiling water down the drain.</li><br /><li>Still not draining? Put on some old clothes, fill the sink or bath halfway with warm water, and grab your plunger. It used to be worse, said Tiong Nam Kuala Lumpur Area Traders Association chairman Ang Khoon Lock.</p><br /><p><span></span>“A year or two ago, it was six months once,” said Ang, who has been making a living as a petty trader in Lorong Haji Taib for 30 years.</p><br /><p>The filthy drain issue is as old as the hills. Numerous complaints have been made but nothing much has changed.</p><br /><p><strong>Who is responsible?</strong></p><br /><div></div><br /><p>At a recent dialogue in Kepong between residents and the authorities over a morning open-air market, it was pointed out to a Kuala Lumpur City Hall (DBKL) senior assistant director that a coffeeshop was discharging wastewater directly into a drain that was also strewn with rubbish and food waste.</p><br /><p>When asked if he could take action, he advised them to refer to the Health and Environmental Department.</p><br /><p>A subsequent meeting with officers from this department revealed that they could fine the premises for lack of hygiene.</p><br /><div><img src="http://www.thestar.com.my/metro/focus/2016/09/14/getting-to-the-bottom-of-drain-cleaning-in-kl-while-city-folk-are-urging-authorities-to-clean-drains/~/media/849da290aa0e4e618a62dcb5e876cb67.ashx" alt="" width="620" height="596" />&lt;/p&gt;<br /><div></div><br /></div><br /><p>But they said the actual act of cleaning the drain itself was no longer under the jurisdiction of DBKL since the Solid Waste and Public Cleansing Management Act 2007 (Act 672) was gazetted on Aug 30, 2007 and enforced on Sept 1, 2011.</p><br /><p>The Act states that the responsibilities of collection and disposal of garbage, as well as cleansing of public roads, public places, public toilets and drains are now under Solid Waste and Public Cleansing Department (PPSPPA) which set the cleaning frequency to once a month.</p><br /><p>The National Solid Waste Management Policy covers Johor, Malacca, Negri Sembilan, Kuala Lumpur, Putrajaya, Pahang, Perlis and Kedah.</p><br /><p>But getting to the reality on the ground, SWCorp Federal Territories director Hazilah Gumri said the local authorities should not completely wash their hands of the matter.</p><br /><p>“The local authorities have to make sure that the drains are structurally sound, not damaged and are functioning properly before the infrastructure is handed to SWCorp for management.</p><br /><p>&#8220;They are responsible to ensure that these drains do not become sewers. This is because they have the power to carry out enforcement,” she said.</p><br /><p>She said the local government and local councils were most needed when it came to obstacles that could hamper the cleaning process.</p><br /><p>“When cars park on the yellow lines in back lanes, the trucks cannot pass through. When shopowners cover their drains, it blocks cleaners from gaining access,” she added.</p><br /><p>At present, the major players tasked with the job of cleaning public drains in all six states and two federal territories are Alam Flora, Environment Idaman and SWM Environment.</p><br /><p><strong>Is once a month enough?</strong></p><br /><p>In the opinion of a member of the public, Abdul Malik Kassim, the drain-cleaning frequency set by PPSPPA may suffice for a quiet residential area but not for a bustling commercial hub.</p><br /><p>“Cleaners not only have rubbish to contend with.
